These Terms of Service (“Terms”) govern your access to and use of the My Mark: Journal & AI Diary mobile application and related services (the “Service”). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1) Who we are
“My Mark: Journal & AI Diary” (“My Mark”, “we”, “us”) provides a journaling application with optional cloud sync, media attachments, PDF export, and AI-assisted features (“Ask Your Journal”).
2) Eligibility
You must be at least 13 years old (or the minimum age required by your country) to use the Service. By using the Service, you represent that you meet this requirement.
3) Account and sign-in
A. Google Sign-In
To use certain features, you may sign in with Google. You are responsible for maintaining the confidentiality of your Google account credentials and for all activity under your account.
B. No access to your Google password
We do not see or store your Google password. Authentication is handled by Google.
4) The Service (what we provide)
My Mark allows you to:
- Create and manage daily journal entries using a calendar-based interface
- Attach photos and voice recordings to entries
- Export entries as PDF (with an option to include images)
- Use cloud sync/backup (e.g., Google Drive, if enabled)
- Use “Ask Your Journal” AI chat (subject to daily usage limits)
- Customize appearance (themes/colors) and enable App Lock (if supported by your device)
We may add, modify, or remove features at any time.
5) Your content
A. Ownership
You own the content you create and upload to the Service (“User Content”), including journal text, photos, and voice notes.
B. License to operate the Service
You grant us a limited, non-exclusive, worldwide license to host, store, process, and display your User Content only to provide and operate the Service (for example, syncing, exporting PDFs, and AI responses when you request them).
C. Your responsibility
You are responsible for:
- The accuracy and legality of your User Content
- Having rights to use and upload any photos, audio, or text
- Maintaining backups if you choose not to enable cloud sync
6) AI features (“Ask Your Journal”)
A. How it works
When you use the AI chat feature, the Service may send your prompt and relevant portions of your journal entries (for example, up to the last 365 days as needed) to an AI service provider to generate a response.
B. AI limitations
AI responses:
- May be inaccurate, incomplete, or inappropriate
- Should not be relied on as professional advice (medical, legal, financial, mental health, or otherwise)
You are solely responsible for how you use AI outputs.
C. Usage limits
AI usage may be subject to limits (e.g., 20 queries/day) and may vary by plan or region. We may adjust limits to prevent abuse or to improve reliability.
7) Sync and backups (Google Drive)
If you enable Google Drive sync:
- Your content may be uploaded to and stored in your Google Drive
- You are responsible for managing your Google Drive storage and permissions
- Disabling sync may stop future uploads/downloads but may not delete existing backups from your Google Drive unless you remove them
8) Premium purchase (one-time purchase)
A. Premium features
Premium may include (examples):
- AI Assistant usage limits or access as described in-app
- Premium themes
- Unlimited photos per entry
- PDF export
- App Lock features (Face ID / PIN depending on device)
The exact Premium entitlements are shown in the paywall and may change.
B. Billing and fulfillment
Premium purchases are processed by Apple App Store or Google Play and validated through RevenueCat. We do not process or store your payment card details.
C. Restore purchases
If supported by the platform, you can restore purchases using the “Restore Purchase” option.
D. Refunds
Refunds are handled by Apple/Google under their policies. We cannot guarantee refunds.
9) App Lock and device security
App Lock helps restrict access to the app on your device, but it does not guarantee complete security. You are responsible for securing your device, your passcodes, and your Google account.
10) Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, or abusive activities
- Attempt to access, probe, or disrupt our systems or security
- Reverse engineer, copy, or misuse the Service except where permitted by law
- Use the AI feature to generate or request illegal content or content that violates others’ rights
We may suspend or terminate access if we believe you violated these Terms.
11) Third-party services
The Service relies on third-party services (such as Google, RevenueCat, app stores, and AI providers). Your use of those services may be governed by their own terms and policies. We are not responsible for third-party services beyond our control.
12) Privacy
Our Privacy Policy explains how we collect and use data. By using the Service, you also agree to our Privacy Policy.
13) Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT.
We do not guarantee uninterrupted or error-free operation, and we do not guarantee that data loss will never occur.
14) Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MY MARK AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
IN ANY EVENT, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD $10, WHICHEVER IS GREATER, UNLESS REQUIRED OTHERWISE BY LAW.
15) Indemnity
You agree to indemnify and hold harmless My Mark from and against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of:
- Your User Content
- Your use of the Service
- Your violation of these Terms or applicable laws
16) Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if required for legal/security reasons.
If you delete the app, local content on your device may be removed; content synced to your Google Drive remains until you delete it from Google Drive.
17) Changes to these Terms
We may update these Terms from time to time. We will update the “Effective Date” and may provide notice in-app where required. Continued use after changes means you accept the updated Terms.
18) Governing law
These Terms are governed by the laws of India, without regard to
conflict-of-law rules.
